1. General Provisions
When a consumer purchases goods or services through this website, the agreement between the parties constitutes a distance contract and is governed by the laws of the Republic of Latvia regulating distance contracts, including but not limited to the Consumer Rights Protection Law and the Cabinet of Ministers Regulations on Distance Contracts.
2. Placing Orders
Product prices and specifications are displayed alongside the products in the Online Store. To place an order, add the desired items to your shopping cart, complete the required fields and select a suitable delivery method. The total order cost, including delivery, will then be displayed. Complete payment to finalise the order.
3. Payment Terms
The currency used in the Online Store is the euro (EUR). Purchases may be paid for by bank transfer or through payment methods offered by Klix by Citadele, operated by AS “Citadele banka”:
- Online banking payments through Latvian banks: Swedbank, SEB, Citadele and Luminor;
- Visa and Mastercard payments.
The contract enters into force when payment has been successfully received in the Online Store's bank account. If an order cannot be fulfilled for any reason, the Buyer will be informed and the amount paid will be refunded as soon as possible, but no later than 14 days after receipt of the notification.
4. Delivery Terms
Goods are delivered within Latvia. Purchased goods are delivered using Omniva parcel lockers, courier services or collection in person. Any duties and taxes payable to receive a shipment at its destination are borne by the Buyer. Delivery charges are displayed before the order is confirmed.
Depending on the selected delivery method and destination, goods are normally delivered to the address provided by the Buyer within approximately 3–10 business days. In exceptional circumstances, the Online Store reserves the right to dispatch goods within up to 45 calendar days, informing the Customer accordingly.
5. Right of Withdrawal
Under Cabinet of Ministers Regulation No. 255 of 20 May 2014, “Regulations on Distance Contracts”, the Buyer has the right to withdraw from the purchase of physical goods within 14 calendar days of receiving them. This consumer right does not apply when the Buyer is a legal entity.
To exercise the 14-day right of withdrawal, goods may be opened but must not be used beyond what is necessary to inspect them. The consumer is responsible for preserving the condition of the goods during the withdrawal period. If goods have been used improperly or damaged through negligent handling, or if their packaging has been substantially damaged, the Online Store may reduce the refund in proportion to any reduction in the goods' value, subject to applicable law.
To exercise the right of withdrawal, contact ngtlatvia@gmail.com. The Buyer must return the goods to the Seller without undue delay and no later than 14 days after notifying the Online Store in writing.
Following receipt of the returned goods, the Online Store will refund the payments received under the distance contract without undue delay and no later than 14 days, subject to applicable law. The Seller may withhold the refund until the goods have been received or evidence of their return has been provided. If the Buyer chose a delivery method more expensive than the least expensive method offered by the Online Store, the additional delivery cost does not have to be reimbursed.
The Online Store is not liable for delays or non-performance caused by circumstances beyond its reasonable control. It reserves the right to refuse a sale and request the return of goods if a clearly erroneous price displayed in the Online Store is substantially below the market price, subject to applicable law.
6. Consumer Rights in Respect of Non-Conforming Goods
The Online Store is responsible for goods that do not conform to the contract or for defects that arise within three months after delivery to the Customer or existed at delivery, unless such a presumption is incompatible with the nature of the goods or the defect.
The Buyer must inform the Seller of any non-conformity promptly and within one month of discovering it by submitting a complaint to ngtlatvia@gmail.com. The Online Store is not responsible for defects caused after delivery to the Buyer.
If purchased goods have defects for which the Seller is responsible, the Buyer may request free repair or replacement. If repair or replacement is not possible, the Seller will refund payments made under the distance contract. The Seller will provide a written response to a consumer complaint within 15 days. These provisions do not limit any mandatory rights granted by applicable consumer protection law.
7. Processing of the Buyer's Personal Data
The Online Store processes personal data provided by the Buyer when placing an order, such as their first name, surname and email address. The Online Store shares personal data with transport service providers as necessary to deliver goods.
If you have expressly agreed to receive our marketing communications, including news, we may occasionally contact you with information about our services and latest offers. 8. Dispute Resolution
For matters not addressed by these Terms and Conditions, the Buyer and Seller agree to comply with the laws and regulations of the Republic of Latvia.
The parties will first seek to resolve disputes through negotiation or correspondence. If a dispute cannot be resolved in this way, it may be referred to a court in the Republic of Latvia in accordance with applicable law. Disputes between a consumer and the Seller may also be referred to the Consumer Rights Protection Centre of Latvia. The Buyer may also contact competent European Union dispute resolution bodies.
